Terms of Service for the trading journal software “Journalyze”, provided by APX Software UG (haftungsbeschränkt).

1. Acceptance of terms

By accessing or using the services provided by APX Software UG (haftungsbeschränkt), you agree to be bound by these Terms of Service.

3. Service description

We provide services including, but not limited to:

  • Trade journaling
  • Trade analysis
  • Publishing and sharing trades

Users are responsible for providing all necessary equipment and internet access to use these services. We may modify or discontinue features; where a change materially reduces the agreed functionality of a paid plan, your statutory rights remain unaffected.

4. Subscription and payment

  • Journalyze is offered on a subscription basis. A free trial may be available; the applicable price, billing interval and any trial period are shown at checkout.
  • Subscriptions renew automatically for the chosen billing interval until cancelled. You can cancel at any time with effect for the end of the current billing period.
  • Our subscriptions are sold and processed by Paddle.com Market Ltd, acting as our reseller and Merchant of Record. Paddle is responsible for the payment transaction, the invoice, and collecting and remitting any applicable VAT or sales tax. Prices for consumers are shown inclusive of applicable VAT.
  • Journalyze is a digital service supplied immediately upon subscription. We do not offer refunds for billing periods that have already begun; this is subject to the right of withdrawal set out below and to mandatory statutory rights.

5. Right of withdrawal (consumers)

If you are a consumer in the EU, you have a statutory 14-day right of withdrawal for distance contracts. Because Journalyze is a digital service provided immediately, you are asked at checkout to expressly consent to performance beginning before the withdrawal period ends and to acknowledge that you thereby lose your right of withdrawal once performance has begun (§ 356(4) BGB). 6. User responsibilities

Users are responsible for the content they upload, including:

  • Execution data
  • Screenshots and screen recordings
  • Journal entries (text notes and tagging)

You must keep your login credentials confidential and must not use the service for unlawful purposes.

7. Data ownership and usage

  • Users retain ownership of all data uploaded to the platform.
  • Users may choose to make their data publicly available.
  • Aggregated and anonymised data, which no longer identifies any individual, may be used by us for statistical analysis and to improve the platform.
  • Our handling of personal data is described in our Privacy Policy.

8. Liability and disclaimers

Journalyze is a journaling and analysis tool. It does not provide investment, financial or tax advice, and we are not responsible for any trading decisions or financial losses. Please read our Risk Disclosure.

We strive to minimise downtime and data inaccuracies but cannot guarantee their complete elimination. We are liable without limitation for damages arising from injury to life, body or health, for intent and gross negligence, and under the German Product Liability Act. For slight negligence we are liable only for breach of an essential contractual obligation (cardinal duty) and limited to the foreseeable, typical damage. Any further liability is excluded.

9. Termination

  • Users can cancel their subscriptions at any time.
  • We reserve the right to terminate accounts for violations of these terms or misuse of the service.

10. Governing law & changes

These Terms are governed by the laws of Germany. If you are a consumer, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of your country of habitual residence.

We may update these Terms from time to time. Users will be notified of significant changes via the email provided during registration or through the platform.
